This Terms of Use applies to Banner Health and its affiliates’ (“Banner”) social media presence on social media sites including, but not limited to, Facebook, Twitter, Instagram, YouTube, Google+, and LinkedIn (“Social Media”), which are all third-party sites not affiliated with Banner.
Content provided on Social Media by Banner, including articles, graphics, photos, video, audio, and trademarked content is owned or licensed to Banner and is subject to applicable intellectual property protections in the United States and elsewhere. Banner is the owner of the trademarks ‘Banner’ and the Banner heart design, which may not be used without express written consent of Banner. Content posted by Banner does not constitute medical advice, nor is it intended to create a doctor-patient relationship with any Banner provider. Consult your physician for medical advice.
By posting content on Banner’s Social Media, linking to Banner’s Social Media, or tagging, hashtagging, or otherwise referencing Banner’s Social Media, you represent and warrant that you solely own the rights, title and interest in any photos, comments, audio, video and other user generated content (“User Content”) and that you hereby grant a non-exclusive, worldwide, perpetual, royalty-free license in such User Content to Banner, which Banner may use, adapt, modify, publish, and sublicense, in whole or in part, including in the promotion of Banner events or services in any print, electronic, digital, audio, video or other format. By posting User Content on Banner’s Social Media, you agree that Banner may use User Content for any business purpose, and that Banner’s use of User Content is authorized without notice, approval, acknowledgement, or compensation to the user. By posting content on Banner’s Social Media, you represent and warrant to Banner that Banner’s use of User Content will not violate any intellectual property rights of the user or any third party, and that you will defend and hold harmless Banner from any such claims.
Banner reserves the right to remove or block User Content from appearing on Banner’s Social Media, in Banner’s sole discretion, including the right to terminate access to or restrict the use of or access to Banner’s Social Media or Websites.
